Flame Broiler Magic Rewards Terms and Conditions

These Magic Rewards Program Terms and Conditions (“Program Terms”) govern your enrollment in and use of The Flame Broiler Inc.’s Magic Rewards Program (the “Loyalty Program”) offered by The Flame Broiler Inc. (“Flame Broiler”, “our”, “us”, “we”). By registering for or using the Loyalty Program, you agree to be bound by these Program Terms. These Program Terms supplement and are subject to Flame Broiler’s Terms of Use and Conditions of Service , including but not limited to the DISPUTE RESOLUTION, ARBITRATION CLAUSE, AND CLASS ACTION WAIVER provisions set forth therein, and Flame Broiler’s Privacy Policy , which describes how we collect, use, and protect your personal information. Both Flame Broiler’s Terms of Use and Conditions of Service and Flame Broiler’s Privacy Policy are incorporated into these Program Terms and made a part hereof.
PLEASE REVIEW THESE PROGRAM TERMS AND THE TERMS OF USE AND CONDITIONS OF SERVICE CAREFULLY AS THEY AFFECT YOUR LEGAL RIGHTS.
1 - Loyalty Program Overview
The Loyalty Program allows eligible participants to earn and redeem loyalty points (“Points”) for qualifying food and beverage purchases at participating Flame Broiler locations and through Flame Broiler’s designated digital channels. 
Points may be redeemed for rewards (“Rewards”) selected by Flame Broiler at our sole discretion. Please visit https://flamebroilerusa.com/rewards/ for additional details regarding Rewards. 
2 - Eligibility
The Loyalty Program is open to legal residents of the 50 United States and the District of Columbia who are at least 18 years of age and who have registered for a Flame Broiler account (“Account”) via the Flame Broiler Mobile App or https://flamebroilerusa.com/account/signin . The Loyalty Program is not targeted towards and is not intended for use by anyone under the age of 18. Flame Broiler may terminate any Account that is suspected to be controlled by any person outside of the U.S. or under the age of 18. The Loyalty Program is void where prohibited by law.
3 - Account Enrollment and Participation
To participate, you must create an Account via the Flame Broiler Mobile App or https://flamebroilerusa.com/account/signin . Each individual is permitted to create and maintain only one (1) Account, and each Account must be associated with a unique email address. Your Account is non-transferable.
By logging into your Account via the Flame Broiler Mobile App or https://flamebroilerusa.com/account/signin , you will be automatically enrolled in the Loyalty Program. You do not need to complete any additional registration to begin participating in the Loyalty Program. By enrolling, you consent to receive Loyalty Program-related communications, including but not limited to emails and push notifications. Flame Broiler is not responsible for any failure to receive such communications due to inaccurate or outdated contact information.
You are responsible for maintaining the confidentiality of your Account information, including your password. If you suspect fraudulent activity or unauthorized access to your Loyalty Account, please notify us immediately at legal@flamebroilerusa.com   Flame Broiler will not be liable for any loss or damage resulting from unauthorized Account access unless otherwise required by law.
4 - Earning Points
Loyalty Program points (“Points”) are earned on qualifying purchases of eligible food and beverage items. To earn Points on qualifying purchases, you must make the qualifying purchase via online ordering or the Mobile App while logged in to your Account. You may also earn Points on qualifying in-store purchases at participating Flame Broiler locations. Visit a participating Flame Broiler location for more information regarding earning Points via in-store purchases. Taxes, gratuities, alcohol, gift cards, merchandise, catering, charitable donations, or purchases made through third-party services are excluded and do not constitute qualifying purchases unless otherwise expressly stated in these Program Terms.
Points will be credited to your Account within 48 hours of each qualifying purchase. Flame Broiler is not liable for delays or errors in point posting. Points are non-transferable and may be revoked, cancelled, or forfeited at any time at Flame Broiler’s sole discretion.
Points have no cash value, are non-redeemable for cash (except as required by law), and may only be used for Rewards offered through the Loyalty Program.
Points do not constitute property and do not create any vested rights or interests. Flame Broiler may revoke, cancel, limit, or modify Points at any time at its sole discretion, even if such changes affect your ability to use previously accumulated Points.
Points may not be purchased, sold, transferred, assigned, or combined across Accounts. Flame Broiler is not liable for Points that are lost, delayed, uncredited, suspended, or revoked due to suspected or actual fraud, unauthorized activity, system error, or other improper conduct.
5 - Bonus Points and Tier Levels
From time to time, Flame Broiler may offer promotional bonus Points for certain types of qualifying purchases or for other reasons for a limited period of time (“Bonus Points”). Flame Broiler may also, from time to time, offer tiered membership levels (“Tier Levels”) based on accumulated Points. Bonus Points and Tier Levels may be subject to additional terms. Tier criteria, benefits, and thresholds are determined solely by Flame Broiler and are subject to change without notice. Bonus Points will contribute towards reaching the Tier Level, but Bonus Points may not otherwise qualify for certain Rewards at Flame Broiler’s sole discretion. 
When available, your Account’s Tier Level will be based on the number of Points earned during a calendar year. Unless otherwise determined by Flame Broiler at our sole discretion, Tier Levels are reviewed annually and may reset at the beginning of each calendar year. Flame Broiler reserves the right to change, discontinue, or revoke Tier Levels and any associated Bonus Points. If you earn enough Points to qualify for a higher Tier Level during the year, Flame Broiler may elevate your status for the remainder of that year and the following calendar year at our sole discretion. 
Flame Broiler may modify Tier Levels at any time, including changing the number of levels, the Points required to qualify, and the benefits or Rewards associated with each level. Your initial Tier Level upon enrolling in the Program will be determined by Flame Broiler at our sole discretion and may be altered by Flame Broiler at our sole discretion.
6 - Expiration and Forfeiture
Points and Rewards will expire as indicated in your Account or as otherwise communicated by Flame Broiler. Points may also be forfeited upon Account closure, inactivity, or violation of these Program Terms. Flame Broiler is not obligated to provide notice before expiration or forfeiture. No reinstatement or compensation will be provided for expired or forfeited Points or Rewards.
7 - Rewards and Redemption
Rewards are subject to availability and change without notice. Redemptions are limited to one (1) Reward per transaction and cannot be combined with other offers unless expressly permitted by us. Additional charges may apply for customizations, including applicable sales tax on customizations. Rewards may only be redeemed at participating Flame Broiler locations in the United States. Participating Flame Broilers locations are subject to change at Flame Broiler’s sole discretion. 
8 - Restrictions, Fraud, and Account Termination
Flame Broiler may suspend or terminate your participation, void Points, Bonus Points, or Rewards, or deactivate your Account at any time at our sole discretion for reasons including, but not limited to, suspected fraud, misuse, or violation of these Program Terms.
9 - Changes to the Loyalty Program
Flame Broiler reserves the right to modify, suspend, or terminate the Loyalty Program or these Program Terms at any time, with or without notice. Any such change will apply prospectively. Continued participation constitutes acceptance of any changes.
10 - Disclaimer and Limitation of Liability — PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR RIGHTS.
THE LOYALTY PROGRAM AND ANY ASSOCIATED POINTS, BONUS POINTS, REWARDS, OR SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, FLAME BROILER DISCLAIMS ALL WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
FLAME BROILER IS NOT RESPONSIBLE FOR UNAUTHORIZED USE, LOSS, ALTERATION, OR DESTRUCTION OF POINTS, BONUS POINTS, OR REWARDS RESULTING FROM FRAUD, ACCIDENT, SYSTEM FAILURE, OR CIRCUMSTANCES BEYOND OUR CONTROL.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL FLAME BROILER OR ITS AFFILIATES, SERVICE PROVIDERS, OR AGENTS BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH THE LOYALTY PROGRAM. YOUR SOLE REMEDY FOR DISSATISFACTION WITH THE LOYALTY PROGRAM IS TO CEASE PARTICIPATION. IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF TWENTY-FIVE DOLLARS (USD $25.00) OR THE VALUE OF THE REDEEMABLE POINTS IN YOUR ACCOUNT.

Flame Broiler is committed to ensuring that our services, including the Loyalty Program, are accessible to individuals with disabilities. If you have difficulty accessing any part of the Loyalty Program, please contact us in accordance with Section 12 of these Loyalty Terms below.
