This California Privacy Notice applies to California Residents who access or use the services, website (the “Site”), digital platforms, marketing activities, social media platforms, mobile app (the “App”), online ordering, in-store WiFi, gift cards, and any other offerings of The Flame Broiler Inc. (“Flame Broiler,” “our,” “us,” or “we”) whether online or in person at our store locations (collectively, our “Services”). This California Privacy Notice describes how we collect, use, and share personal information about our consumers who reside in California along with a description of the rights California residents have regarding their personal information as required by the California Consumer Privacy Act (“CCPA”), as amended by California Privacy Rights Act (“CPRA”), and its implementing regulations.
This Privacy Policy provides the information the CCPA requires, together with other useful information regarding our collection and use of personal information. Any terms defined in the CCPA have the same meaning when used in this California Privacy Notice.
For California residents, this California Privacy Notice is intended to supplement Flame Broiler’s Privacy Policy, which is incorporated herein by reference. This California Privacy Notice does not apply to our collection and use of personal information from residents outside of California. Consumers residing in other locations should see our Privacy Policy.
NOTICE AT COLLECTION
We collect the following categories of personal information or sensitive personal information for the purposes described in this California Privacy Notice. We do not sell personal information or sensitive personal information for monetary consideration. However, some of our advertising practices may constitute “sharing” under California law.

YOUR RIGHTS AND CHOICES
Under the CCPA, California residents have the following rights regarding their personal information:
  • Right to Know and Data Portability: You have the right to request that we disclose certain information to you about our collection and use of your personal information over the past 12 months (or longer upon request, where feasible). This includes the categories and specific pieces of personal information collected; the categories of sources from which it was collected; the business or commercial purposes for collecting, selling, or sharing it; and the categories of third parties with whom it was shared or sold. You may exercise this right up to twice in a 12-month period. When your request includes a data portability request, we will provide your personal information in a portable and readily usable format, subject to redactions.
  • Right to Delete: You have the right to request that we delete any of your personal information that we collected and retained, subject to certain statutory exceptions (e.g., for legal compliance or security purposes). If your request is granted, we will also notify our service providers and contractors to delete the data.
  • Right to Correct: You have the right to request correction of inaccurate personal information that we maintain about you. We may require documentation to support the accuracy of the correction and will notify relevant service providers and contractors of the correction where applicable.
  • Right to Opt-Out of Sale or Sharing: You have the right to opt out of the sale or sharing of your personal information, including through an opt-out preference signal (e.g., Global Privacy Control). We do not sell or share the personal information of individuals we know to be under 16 without affirmative authorization. Once you opt out, we will not sell or share your personal information unless you later opt in.
  • Right to Limit Use and Disclosure of Sensitive Personal Information: You have the right to request that we limit our use and disclosure of your sensitive personal information to only those uses permitted by the CCPA. However, we do not use or disclose sensitive personal information in ways that trigger this right.
  • Right to Non-Discrimination: You will not receive discriminatory treatment by us for exercising any of your rights under the CCPA. Legitimate denial of a request based on an exception or inability to verify identity does not constitute discrimination.
HOW TO EXERCISE YOUR RIGHTS
To exercise your right to know, delete, correct, obtain a copy of your personal information, and/or limit or opt out of the sale or sharing of personal information, please submit a verifiable request by:

Please include sufficient detail so we can properly understand, evaluate, and respond to it. You or your authorized agent may only submit a request to know (including for data portability) twice within a 12-month period.
MINOR PRIVACY AND OPT-IN REQUIREMENTS
As provided in our Privacy Policy, we do not knowingly collect personal information from individuals under the age of 18. We do not knowingly sell or share the Personal Information of individuals under the age of 16 without the required affirmative authorization:
  • For minors aged 13 to 15, we will only sell or share personal information if the individual has affirmatively opted in to such use.
  • For children under 13 years old, a parent or legal guardian must provide verifiable consent before any sale or sharing of Personal Information.
Consumers who have opted in to the sale or sharing of their Personal Information may opt out at any time by submitting a request via the methods described in the “How to Exercise Your Rights” section above.
If we have reason to believe a user is under the applicable age threshold, we will not process their personal information for sale or sharing until proper authorization is obtained.
VERIFICATION AND RESPONSE PROCESS
Only you, or someone legally authorized to act on your behalf, may make a request to know, delete, or correct your personal information. If your child is a minor (under the age of 18), you may submit a request on their behalf. We may require specific information to confirm your identity or your agent's authority, and we will only use that information to process and verify your request.
We will confirm receipt of your request within 10 business days and respond substantively within 45 days (or up to an additional 45 days with notice). Responses will be delivered through your verified contact method and will state whether we have complied with your request. If not, we will explain why. We may refuse access under applicable law or if we no longer retain your personal information.
For data portability, we will provide your personal information in a usable format. We do not charge a fee unless your request is excessive, repetitive, or manifestly unfounded. If a fee applies, we will provide a cost estimate and explanation before completing the request.
For limit or opt-out requests, we will comply within 15 business days and notify service providers or contractors to honor your request. We will not ask you to reauthorize for 12 months but you may opt back in at any time.
